 Terms & Conditions: Print & Canvas sales

0.1 These terms and conditions apply to the purchase of all forms of photographic print and canvas ( herein “print”).

0.2 The terms and conditions below form part of the contract between us (“our”, “Julia Nance”, “we”) and you (“buyer”, “customer”, “you”) and are the basis on which any disagreement will be considered.

0.3 By purchasing a print or canvas, you are acknowledging and agreeing to the terms and conditions set about below.

1. Definition of Prints

1.1 “Lustre Print” –  Lustre prints are printed on Ilford Galerie Smooth Pearl: a high-density, resin coated heavyweight base and smooth pearl finish. Each print will come with a printed white border, and will be signed by Julia Nance. All Lustre prints will be inspected before shipping.

1.2 “Fine Art Cotton Rag Print” – Fine Art Cotton Rag prints are printed on Ilford Galerie Smooth Cotton Rag: 100% Cotton rag paper, with no optical brighteners and the longevity, image stability and a clean matt surface required for the very best in fine art printing. Each print will come with a printed white border, and will be signed by Julia Nance. All Fine Art Cotton Rag prints will be inspected before shipping.

1.3 “Stretched Canvas Print” – All canvas prints will have a 2″ edge, and will be ready to hang. The printed surface will contain a UV laminate protective coating, to protect the surface. Each canvas will have the edges printed with image-wrap or mirror-wrap. The back of each canvas will be signed by Julia Nance. All Stretched Canvas prints will be inspected before shipping.

2. Customer Responsibilities

2.1 By purchasing a print, you are confirming that you have read the associated print description, and selected the appropriate print type and size as required by you.

3. Orders

3.1 You are responsible for ensuring the completeness and accuracy of your order details and Julia Nance will not be liable for any failure by you to provide complete and accurate information in your order.

3.2 All print and canvas orders are made to order. Your order will be confirmed first via automatic email, and then via a personal email from Julia with confirmation and a final, official invoice.

3.3 We reserve the right to cancel any order before delivery of the relevant print in the event any payment of the full order value fails.

3.4. Without limitation to any provisions relating to Limitation of Liability, we will not be liable or otherwise responsible for any loss or damage caused to the you by cancellation of an order by us.

4. Production and Shipping

4.1 Julia will aim to have your order processed, printed, and shipped as soon as possible. Please expect at least one week for prints to be shipped, and two weeks for canvas orders to be shipped. Duration of shipping time depends on your location, and can often be upwards of one week. We are unable to control the speed of the shipment.

4.2 If you require your order by a certain date, please contact Julia as soon as you make your order. We will endeavour to complete your order in time, and will notify you before production time if we are unable to do so. However, we cannot guarantee shipment to arrive on any particular date – the shipment is in the hands of our shipping provider.

4.3 Your order will be considered completed when we deliver your print(s) or canvas(es) to the shipping address you provided when you made your online order.

4.4 Items will be shipped with Australia Post, and their associated couriers. If you are not home at time of delivery, you may either have to wait for the items to be re-delivered, or you may need to pick up your package from your local Post Office.

4.5 Once your prints or canvas have arrived, it is your responsibility to inspect for damage or abnormality, and contact us if there is a problem. Once the prints or canvas have been delivered, they will be your responsibility, and we cannot be liable for any damage that occurs to the prints under your care. We ask you take as much documentation and photograph any damage that occurs during delivery, and we will contact Australia Post or our couriers.

4.6 If your items arrive damaged, you must inform us immediately, within 24 hours, providing detailed notes and photographs. Your damaged items need to be returned to us, where we will inspect and re-print if necessary.

4.7 You must inform us of any damage to your prints or canvas within 24 hours of delivery in order to qualify for a refund.

4.8 Ownership of your prints or canvas will be yours, once paid and delivered. You do not own the copyright of the actual photographic artwork.

4.9 Once your prints have been delivered, we will not be liable to any damage to your prints or canvases in your possession. If a defect occurs, please contact us so we can find a resolution.

5. Returns

5.1 All print orders are made to order. Your order cannot be refunded once production has started on your product. If you do change your mind, please contact us ASAP, to ensure that we can refund or change your order, before we start production.

5.2 If your order was damaged during delivery, and you informed us within 24 hours of the delivery (subject to clause 4 – “Production and Shipping”), we will replace your print(s) or canvas(es) free of charge, upon return of your original items.

5.2 All orders that are delivered and confirmed as undamaged, or where we have not been informed of any courier damage within 24 hours of delivery, are deemed to have been accepted by you in good condition and will no longer be replaced by us for free on return of the damaged item for disposal.

5.3 If your print or canvas has been damaged in your care, we cannot replace your item. You may re-purchase via our website, where you will find our current prints and canvas for sale, as well as our price list.

5.4 It is your responsibility to arrange framing for your prints. If your prints are damaged during your framing process, we will not be responsible for replacing or refunding your order.

6. Delivery: Australia and International

6.1 All prints and canvas are produced and shipped from Melbourne, Australia, using high quality materials and inks, and shipping via Australia Post.

6.2 Items cannot be guaranteed to be delivered on a certain date or at a certain time. Shipping and delivery is dependant on the courier, and while we will endeavour to get your order to you in a timely manner, delays and unexpected events can disrupt the shipping schedule. We are unable to provide refunds if there delays in shipping, or if your order arrives prior to your expectation.

6.3 For international shipments, we will ensure the value of your order is correctly declared for importation.

6.4 If you are an international customer, you may be subject to taxes and duties in your country of delivery. We are unable to predict what these charges are, and they will be on top of the current shipment rate. These charges are your responsibility.

7. Pricing

7.1 Pricing on our website is subject to change. We will ensure that price changes do not affect any order that has been confirmed.

7.2 The price of a Product does not include delivery charges. Our delivery charges are as quoted on our site from time to time. To check relevant delivery charges, please refer to the “Delivery” line at checkout, or in the case of bespoke images this can be found on your written quotation.

7.4 If an error occurs with the pricing on our website, we have the right to inform you and amend your order. Your order will be held until we have written confirmation if you want to proceed or cancel your order.  Please note that if the pricing error is obvious and could have reasonably been recognised by you as an error, we do not have to provide the prints to you at the incorrect (lower) price.

8. Packaging of shipments

8.1 All prints will be delivered in secure postal tubes. Stretched canvas will be packaged securely.

9. Copyright and Ownership

9.1 By purchasing a print from us, you understand that you own a copy of an original photograph as captured by the original creator, Julia Nance.

9.2 At no point do you, or will you, own the copyright of any image purchased from us as a print.

9.3 You may not reproduce or copy your prints (scanned, photographed, shared electronically, re-sold or reprinted). You may not use your prints for commercial use without an agreed license – which can be purchased for a fee.

10. Payment

10.1 Our payment options include payment, or manual bank transfer.

10.2 For Paypal payment, you may pay with a card or via your paypal account.

10.3 Manual Payment will involve an invoice being sent to your email, as provided to us by you, with bank transfer details. Your order will be processed once the complete funds have transferred into our nominated bank account.

10.4 All payment must be made in full before production and shipping of any prints or canvas.

10.3 Upon our sending of your order confirmation by email, this contract is then deemed to be in force and all applicable clauses and terms apply.

10.4 Once delivery of your order has been signed for as accepted, your order and payment are considered complete.

11. Our Right to Vary These Terms

11.1 We may revise these Terms from time to time.

11.2 Every time you order prints from us, the Terms in force at that time will apply to the Contract between you and us.

12. Your information

12.1 Your information will not be sold or shared. We are the sole owners of the information collected on this site.

12.2 The information you provide us will be used to contact you, or fulfill your order.

12.3 Security: we use a secure SSL encryption, and all our payment information is processed securely via Paypal (or manual bank transfer at your request).
